Temporary Contract Trademark Counsel

This is a fully remote position, open to applicants in Louisiana.

📋 Description

• Manage daily trademark protection and enforcement operations.

• Provide guidance to the Associate General Counsel, IP, regarding new trademarks, advertising usage of marks, copyright, domain names, social media, and associated activities.

• Assist in the protection and enforcement of The Wonderful Company and its affiliate trademark portfolios.

• Conduct and assess clearance searches for new trademarks, analyze the findings, and deliver risk assessments.

• Offer advice and occasionally draft substantial responses to USPTO Office Actions.

• Independently oversee U.S. enforcement activities, which include priority investigations, cease and desist communications, negotiations with opposing counsel, and settlement agreements.

• Supervise foreign legal counsel on enforcement matters.

• Meet opposition and other deadlines and report to the Associate General Counsel, IP, and foreign counsel.

• Draft initiating TTAB documents and oversee corresponding foreign documents.

• Support in-house and foreign litigation counsel throughout oppositions, cancellations, civil litigation, and other legal proceedings.

• Draft, negotiate, and provide counsel on trademark, copyright, and publicity rights agreements and issues, including licenses, consents, assignments, settlements, and co-branding agreements.

• Complete special projects, including M&A due diligence.

⛳️ Requirements

• A minimum of 4-7 years of substantial experience in domestic trademark prosecution and enforcement.

• Juris Doctor degree from an accredited law school.

• Active membership in good standing with the respective state bar association.

• Demonstrated experience in conducting risk assessments for the usage and enforcement of trademarks across various media and industries.

• Experience in drafting trademark agreements, such as assignments and licenses.

• Capability to collaborate with paralegals to manage a high volume of trademark deadlines.

• Excellent analytical abilities and creative problem-solving skills.

• Exceptional written and verbal communication skills, with the capacity to engage with business stakeholders in a business-friendly manner.

• Strong organizational skills and meticulous attention to detail, along with effective follow-up abilities.

• Outstanding interpersonal skills, even under deadline pressure.

• Ability to work independently and take full responsibility for consistently delivering complete and accurate work.

• Proficient in USPTO and/or Saegis trademark searching and capable of quickly learning and utilizing other software applications.

• Diligent and detail-oriented, showcasing commitment to professionalism, adaptability, and a willingness to engage in a diverse range of matters.

• In-house trademark experience is highly preferred.

• International trademark experience is advantageous, but not mandatory.

• Familiarity with copyright, patent, and/or trade secret law is a plus.

• Experience with trademark issues related to major consumer products is an added advantage.
