This is a fully remote position, open to applicants in Texas.

📋 Description

• Oversee all aspects of commercial litigation, from pre-suit investigations to pleading, discovery, trial, and post-judgment enforcement.

• Manage disputes related to MCA agreements, commercial guarantees, merchant defaults, stacking issues, and disputes with payment processors.

• Develop and implement recovery strategies, including bank restraints, property liens, wage garnishments, actions for fraudulent conveyance, and post-judgment subpoenas.

• Prepare pleadings, emergency motions, summary judgment motions, and appellate briefs.

• Represent clients in oral arguments, hearings, depositions, mediations, and trial proceedings.

• Provide guidance to lenders, funding companies, and financial institutions regarding risk mitigation, portfolio recovery, and adherence to commercial finance regulations.

⛳️ Requirements

• Must hold a license to practice in Texas and reside in Houston or nearby areas.

• Juris Doctor (JD) degree from a recognized law school.

• Active bar admission in good standing within the primary operating jurisdiction.

• Over 5 years of specialized experience in commercial litigation, with a focus on MCA litigation, debt collection, and creditors’ rights.

• Comprehensive knowledge of the Uniform Commercial Code (UCC) Articles 3 and 9, as well as state judgment enforcement procedures and commercial contract law.

• Proven history of motion practice, trial involvement, and emergency relief hearings.

• Capability to handle a substantial caseload independently while maintaining meticulous attention to detail in a fast-paced setting.

• Experience with bankruptcy proceedings, including Chapter 7, 11, and 13 cases, adversary proceedings, and motions for relief from stay.

• Familiarity with regulatory changes impacting the MCA and alternative finance sector.
