Senior Labor & Employment Counsel

📋 Description

• Oversee all employment-related litigation, including strategies for litigation and settlement, negotiations, selection of outside counsel, management of fees and costs, and coordination with ABB business units.

• Develop strategies for union contracts and engage in union negotiations as required.

• Handle union-related matters, including avoidance strategies, organizing campaigns, and labor arbitrations.

• Offer legal counsel to HR professionals and company management on employment matters, agreements, restrictive covenants, and applicable state and federal employment laws.

• Conduct labor and employment due diligence in the context of acquisitions.

• Provide guidance on internal investigations regarding compliance with the code of conduct and human resources policies.

• Review and advise on employment policies and procedures, ensuring updates align with evolving laws.

• Keep HR teams and management updated on legal and legislative changes affecting employment and labor relations.

• Supervise fiduciary responsibilities for Benefit and Investment Committee issues to ensure adherence to ERISA standards.

• Counsel on new HR and Labor & Employment technologies, including digital assessments, while addressing organizational risks and potential litigation.

• Manage legal administrative charges from external agencies, such as the EEOC and NLRB.

• Conduct mediations arising from external claims.

• Facilitate compliance training related to employment and create and deliver training programs.

• Design and implement “train the trainer” compliance programs in the workplace.

• Identify potential risks and exposures, implementing actions to mitigate these through audits, training, and policy evaluations.

• Ensure proper corporate governance within the country, including structuring, drafting, and negotiating M&A and divestiture transactions.

• Serve as a strategic business partner across all Business Areas, supporting regional strategies for Motion.


⛳️ Requirements

• Juris Doctor degree.

• Minimum of 10+ years of experience in US Employment and Labor Law.

• Preferred additional Bachelor’s degree in Business or Human Resources.

• Prior litigation experience or significant experience managing litigation as an in-house attorney.

• Proficiency in researching, reviewing, and understanding local, state, and federal employment laws relevant to the Company’s operations.

• Excellent interpersonal skills, particularly in negotiations.

• Exceptional communication skills (both verbal and written) with stakeholders at all levels, both internal and external.

• Proven ability to manage multiple tasks efficiently.

• Strong organizational, collaborative, and follow-up abilities.

• Experience in a multinational setting and providing advice on multi-jurisdictional or cross-border projects, including involvement in strategic business decisions.

• Willingness to work flexible hours when necessary to collaborate with global colleagues.

• Ability to travel as required.

• Candidates must already have authorization to work for ABB in the US.
