Labor Litigation Attorney

This is a fully remote position, open to applicants in Brazil.

📋 Description

• Drafting defenses, motions, objections, and appeals across all court levels.

• Preparing hearing briefs for local counsel, which include legal strategies, necessary objections to preserve for appeal, questions for witnesses, and limits on settlement authority.

• Reviewing hearing minutes to identify rulings and issues that have been waived or forfeited, while reiterating objections in closing submissions.

• Managing judgment liquidation and enforcement proceedings, such as contesting calculations, motions to stay or oppose enforcement, and defenses against asset freezes.

• Drafting questions for expert witnesses, analyzing expert reports, and coordinating with technical assistants.

• Requesting and organizing supporting documents and information from clients.

• Maintaining updated case files in the system, ensuring tasks, deadlines, and provisions are managed on schedule.

⛳️ Requirements

• A law degree and active registration with the Brazilian Bar Association (OAB).

• Experience in labor litigation on the defendant side, overseeing a high-volume caseload.

• Strong understanding of the litigation process, including merits, appeals, judgment liquidation, and enforcement.

• Familiarity with outsourcing and subsidiary and joint liability, encompassing TST Precedent 331, STF ADC 16 and Theme 246, culpa in vigilando, and issues pertinent to public-sector contracting entities.

• Knowledge of evidentiary hearings.

• Experience in managing technical evidence, including formulating expert questions, reviewing reports, and collaborating with technical assistants in cases related to unhealthy and hazardous work conditions.

• Competence in utilizing case-management platforms that monitor tasks and deadlines.
