Compliance Counsel

This is a fully remote position, open to applicants in Massachusetts.

📋 Description

• Provide counsel to the organization regarding laws and regulations that impact customer clinical service delivery, which includes privacy, security, health information exchange, payment rules, fraud prevention, waste management, abuse prevention, and quality program reporting.

• Monitor, assess, and provide guidance on legislation, regulations, and directives related to AI at federal, state, and international levels.

• Participate in the AI governance team, offering advice to product, engineering, and business teams on compliance responsibilities and risk management strategies.

• Create and uphold internal AI governance frameworks, policies, and procedures.

• Collaborate with data science, engineering, product, and public policy teams throughout the AI development process.

• Educate stakeholders on principles of risk management and organizational compliance initiatives.

• Provide counsel regarding HIPAA, 42 CFR Part 2, federally funded value-based care initiatives, electronic health record technology certification, clinical specialties, and relevant state laws.

• Analyze and interpret federal rulemaking and guidance from agencies such as CMS, ONC, and OIG.

• Develop and execute compliance programs based on regulatory guidance.

• Investigate emerging regulatory changes and case law pertinent to athenahealth and the healthcare technology sector.

• Conduct independent investigations into compliance issues, internal inquiries, and corrective measures.

• Track policy developments that are relevant to healthcare technology products and services.

⛳️ Requirements

• Minimum of 3 years of regulatory legal experience in a healthcare or technology firm, a mid to large-sized law firm, or in a governmental role.

• Juris Doctor (J.D.) degree from a respected law school.

• Outstanding academic qualifications.

• Admission to a U.S. state bar in good standing.

• Experience in project management.

• Proven ability to coordinate efforts among a diverse group of attorneys and business stakeholders across an organization.

• Familiarity with drafting organizational policies and procedures related to healthcare regulations.

• Experience in providing legal and strategic advice on risk assessments and mitigation strategies.

• Knowledge of FDA and similar electronic prescribing guidelines and requirements.

• Understanding of Medicare reimbursement, audit, and billing regulations.

• Comprehensive experience in healthcare compliance programming; certification such as HCCA is highly desirable.
