Claims Counsel, Management Liability

This is a fully remote position, open to applicants in United States.

📋 Description

• Manage a portfolio of intricate and high-severity Management Liability claims independently, which includes Directors & Officers Liability, Employment Practices Liability, Fiduciary Liability, Crime, and associated financial lines claims.

• Evaluate policy coverage and draft reservation of rights, coverage position, and declination letters.

• Perform factual, legal, financial, and coverage assessments to determine liability, damages, and exposure.

• Set and uphold claim reserves within the authority granted and request additional authority as necessary.

• Assess settlements and engage in mediations, settlement conferences, and various dispute resolution processes.

• Oversee litigation involving insured organizations and individual directors, officers, trustees, and executives.

• Retain, manage, and assess defense and coverage counsel.

• Review and approve litigation budgets, oversee legal expenditures, and negotiate alternative fee structures.

• Formulate and execute litigation and resolution strategies.

• Counsel underwriting on claims trends, emerging risks, coverage matters, and portfolio performance.

• Collaborate with underwriting teams on product enhancements and risk selection.

• Analyze claims trends and portfolio data to provide actionable business insights.

• Prepare reports for carrier partners and reinsurers, participating in stewardship discussions and portfolio evaluations.

• Cultivate relationships with brokers, insureds, carrier partners, and defense counsel.

• Engage in broker stewardship meetings, claim reviews, underwriting roundtables, and presentations to the market.

• Mentor junior claims professionals.

• Take part in claims audits, quality assessments, training, and process improvement initiatives.

• Support efforts to enhance claims operations and service delivery.

• Utilize claims technology, automation, and AI tools to boost efficiency and outcomes.

• Ensure adherence to delegated authority agreements, carrier guidelines, service standards, and relevant regulations.

⛳️ Requirements

• Juris Doctor (JD) degree with active bar membership.

• At least 7-10 years of experience managing Management Liability claims.

• Proficiency in analyzing coverage for private company D&O, nonprofit organization liability, EPL, and Fiduciary Liability.

• Experience in drafting complex reservation of rights letters, coverage position letters, and declination letters.

• Background in handling shareholder and ownership disputes involving closely held entities; governance and executive liability disputes; regulatory and governmental investigations; and bankruptcy, insolvency, trustee, receiver, creditor, and related executive liability claims.

• Strong knowledge of Management Liability policy forms, endorsements, and coverage structures.

• Ability to independently handle high-severity and complex claims.

• Excellent analytical, negotiation, litigation management, financial analysis, and relationship management abilities.

• Outstanding written, verbal, and presentation skills.

• Strong strategic decision-making and business acumen.

• Proficiency in Microsoft Office and claims management systems.

• Capability to function effectively within a small, collaborative, high-performing team aligned with company values.

• Preferred: Experience managing claims involving private equity-backed, venture-backed, founder-led, or closely held organizations.

• Preferred: Experience within an MGA, specialty insurer, E&S carrier, or Management Liability insurance provider.

• Preferred: Experience working under delegated claims authority.

• Preferred: Experience presenting claims trends, portfolio analytics, and emerging risks to senior management, underwriters, brokers, and carrier partners.

• Preferred: CPCU, RPLU, SCLA, ARC, or similar industry designation.
