Claims Counsel, Management Liability

This is a fully remote position, open to applicants in United States.

📋 Description

• Oversee a portfolio of intricate and high-severity Management Liability claims, which include Directors & Officers Liability, Employment Practices Liability, Fiduciary Liability, Crime, and related financial lines claims.

• Assess policy coverage and draft reservation of rights letters, coverage position letters, and declination letters.

• Perform factual, legal, financial, and coverage evaluations to assess liability, damages, and exposure.

• Set and manage claim reserves within assigned authority and seek additional authority as necessary.

• Identify settlement opportunities and engage in mediations, settlement conferences, and various dispute resolution activities.

• Manage litigation involving insured organizations alongside individual directors, officers, trustees, and executives.

• Hire, oversee, and assess defense counsel and coverage counsel.

• Review and approve litigation budgets, monitor legal expenses, and negotiate alternative fee structures.

• Formulate and execute litigation and resolution strategies.

• Provide insights to underwriting regarding claims trends, emerging risks, coverage concerns, and portfolio performance.

• Collaborate with underwriting teams on product improvements and risk selection.

• Analyze claims trends and portfolio metrics to detect emerging exposures and deliver business insights.

• Prepare reports for carrier partners and reinsurers, engaging in stewardship discussions and portfolio evaluations.

• Foster relationships with brokers, insureds, carrier partners, and defense counsel.

• Take part in broker stewardship meetings, claim assessments, underwriting discussions, and market-facing presentations.

• Mentor junior claims professionals.

• Engage in claims audits, quality assessments, training programs, and process enhancement projects.

• Contribute to strategic initiatives aimed at improving claims operations and service delivery.

• Leverage claims technology, automation, and AI-driven tools to boost efficiency and claim outcomes.

• Ensure adherence to delegated authority agreements, carrier policies, service standards, and relevant regulations.

⛳️ Requirements

• Juris Doctor (JD) degree and active bar membership.

• At least 7-10 years of experience managing Management Liability claims.

• Proven expertise in private company D&O, liability for nonprofit organizations, EPL, and Fiduciary Liability coverage analysis.

• Extensive experience in drafting complex reservation of rights letters, coverage position letters, and declination letters.

• Significant experience handling shareholder and ownership disputes involving closely held entities; governance and executive liability disputes; regulatory and governmental investigations; and bankruptcy, insolvency, trustee, receiver, creditor, and associated executive liability claims.

• Strong comprehension of Management Liability policy forms, endorsements, and coverage structures.

• Proven capability to independently manage high-severity and complex claims.

• Excellent analytical, negotiation, litigation management, financial analysis, and relationship management skills.

• Outstanding written, verbal, and presentation abilities.

• Strong business acumen and strategic decision-making skills.

• Proficient in Microsoft Office and claims management systems.

• Ability to function effectively within a small, collaborative, high-performing team aligned with company values.

• Preferred: Experience managing claims for private equity-backed, venture-backed, founder-led, or closely held organizations.

• Preferred: Experience within an MGA, specialty insurer, E&S carrier, or Management Liability insurance provider.

• Preferred: Experience operating under delegated claims authority.

• Preferred: Experience presenting claims trends, portfolio analytics, and emerging risks to senior management, underwriters, brokers, and carrier partners.

• Preferred: CPCU, RPLU, SCLA, ARC, or similar industry accreditation.
