This is a fully remote position, open to applicants in Argentina.
• Lead and cultivate the settlement negotiators and support team through processes such as hiring, onboarding, training, and performance management.
• Conduct structured one-on-one meetings, file reviews, and coaching sessions with documented follow-ups.
• Develop individualized growth plans aimed at enhancing valuation accuracy, negotiation skills, and file processing speed.
• Collaborate with Human Resources to address performance and conduct-related issues.
• Own departmental KPIs, which include settlement volume, average settlement value, policy-limits capture rate, net client recovery, pre-suit stage duration, aged-file exposure, demand turnaround time, and negotiator productivity.
• Establish individual and team benchmarks that take into account jurisdiction, case type, treatment approach, coverage, and liability profile.
• Review pipeline and performance metrics weekly to identify causes of performance fluctuations and implement corrective measures.
• Report on department performance, forecasts, and risks to firm leadership.
• Manage aged and stalled inventory effectively.
• Act as the final internal authority on case valuation and settlement strategy within set approval limits.
• Review and authorize demand packages, settlement authority requests, and counteroffers.
• Apply and educate on valuation methodologies across various injury types, including soft tissue injuries, injections, surgical interventions, and traumatic brain injuries.
• Identify situations of bad faith, policy-limits opportunities, UM/UIM exposure, and coverage concerns.
• Personally manage or co-manage high-exposure and sensitive negotiations.
• Maintain and enhance standard operating procedures (SOPs), checklists, templates, and case-stage definitions.
• Collaborate with medical management on treatment monitoring, record-keeping, billing, reductions, and lien resolutions.
• Coordinate with intake, case management, and litigation teams for seamless handoffs and feedback on case quality.
• Ensure that negotiated resolutions are documented, compliant, client-approved, and disbursed accurately and promptly.
• Propose and implement enhancements in technology, reporting, and workflow processes.
• Establish standards for client settlement counseling and effective valuation communication.
• Ensure that client communication occurs in their preferred language.
• Address escalated client concerns and identify opportunities for process improvements.
• Three to five years of progressive experience in personal injury, with significant time spent in pre-suit settlement and negotiation.
• A minimum of three years directly managing a settlements, pre-litigation, or case management team.
• Proven experience in taking responsibility for the results of others.
• Demonstrated ability to manage using metrics, including establishing performance standards, tracking performance, coaching underperformers, and ensuring accountability.
• Strong knowledge of case valuation, covering medical specials, treatment trajectories, procedure-level valuation, comparative fault, coverage layers, and venue analysis.
• Fluency in both English and Spanish, both written and spoken.
• Familiarity with Florida personal injury practices, including PIP, the statutory pre-suit framework, and relevant damages and fee regulations.
• Comfort in utilizing case management systems, reports, and spreadsheets.
