This is a fully remote position, open to applicants in United States.
• Offer daily legal counsel regarding wage and hour regulations, FMLA, ADA, Title VII, and specific state employment laws.
• Tackle workforce challenges in home care, including live-in caregiver exemptions, travel time compensation, and joint-employment risks.
• Keep abreast of federal and state labor legislation impacting the Medicaid and healthcare industries.
• Ensure employment practices are in accordance with Medicaid provider enrollment guidelines, EVV requirements, and state program integrity standards.
• Provide guidance on compliance for background checks, exclusion screenings, and required health screenings.
• Collaborate to prepare for audits by state health agencies and managed care organizations.
• Draft, revise, and implement employee handbooks, arbitration agreements, and separation agreements.
• Review and formulate independent contractor agreements and vendor contracts.
• Create and conduct training on employment best practices for HR and operational managers.
• Handle and resolve pre-litigation employment claims, administrative charges, and wage audits.
• Supervise outside legal counsel during employment litigation or class-action defenses.
• Lead internal investigations concerning allegations of harassment, discrimination, or retaliation.
• Advise executive leadership and HR teams on workforce management, compliance, and risk reduction strategies.
• May oversee one or more paralegals.
• Juris Doctor degree is mandatory.
• Active legal practice license is required.
• A minimum of 10 years of concentrated experience in labor and employment law is essential.
• Capability to interpret state and federal anti-discrimination and wage-hour regulations within complex business operations.
• Proficiency in drafting clear and organized position statements and legal documentation.
• Skill in negotiating and drafting settlement agreements and releases.
• Experience managing state and federal employment-related litigation.
• Ability to communicate effectively and succinctly with executive leadership, translating legal concepts into actionable business solutions.
• Capacity to provide sound legal advice and practical judgment.
• Competence in managing a high volume of urgent inquiries.
• Knowledge of state and federal information privacy and security regulations as they pertain to employment issues.
• Proficient in drafting policies, contracts, and memoranda.
• Exceptional legal writing and interpersonal skills are required.
• Admission to the New York or California bar is advantageous.
• Previous experience in-house or at a large law firm is preferable.
• Expertise in labor relations is highly valued, including collective bargaining negotiations, NLRA compliance, labor arbitrations, union organizing, and employment risk management.
• Experience with Medicaid HCBS programs is a bonus.

• Competitive base salary ranging from $180,000 to $215,000 per year.
