Assistant General Counsel, Servicing

This is a fully remote position, open to applicants in United States.

📋 Description

• Act as the primary legal advisor for GoodLeap’s Servicing Team.

• Provide daily assistance and immediate operational support to the Servicing organization.

• Offer guidance on loss mitigation initiatives, collections strategy, default management, and adherence to regulatory standards.

• Lead compliance assessments and formulate policies in accordance with Reg X (RESPA), Reg Z (TILA), FDCPA, UDAAP, TCPA, relevant state servicing and collections laws, as well as GSE and agency servicing guidelines.

• Draft, evaluate, and uphold loss mitigation policies, collections strategies, and servicing procedures.

• Identify, evaluate, and mitigate legal and regulatory risks while advising on the structuring of current and new investment products and strategies.

• Keep track of regulatory changes and guide the implementation of new rules impacting servicing and collections operations.

• Review and negotiate vendor contracts and Statements of Work (SOWs) that support collections and default management activities.

• Collaborate with Capital Markets and Portfolio Management on servicing representations, covenants, and compliance obligations in asset sale and securitization transactions.

• Assist in managing regulatory examinations and address consumer complaints escalated through CFPB, state agencies, or litigation avenues.

• Serve as the primary legal contact for issues pertaining to serviced loan portfolios, customer communications, and servicing operations.

• Report directly to the Deputy General Counsel, Executive Vice President.

⛳️ Requirements

• At least 10 years of experience as a practicing attorney, with significant time dedicated to consumer loan servicing, collections, or default management—preferably including in-house experience at a consumer finance and/or mortgage servicer or subservicer, GSE/agency approved seller-servicer and/or consumer finance lender.

• Extensive knowledge of servicing and consumer debt collections laws and practices, as well as applicable state collections and foreclosure laws (e.g., FDCPA, TCPA, FCRA, UDAAP, TILA, RESPA, ECOA, etc.) and associated title and lien resolution matters.

• Proven experience advising on loss mitigation structuring and post-default strategies within a consumer finance, mortgage finance, or home improvement lending context.

• Proficient understanding of FDCPA and TCPA compliance for collections outreach, state collections licensing requirements, and the regulatory classification of collections operations.

• Familiar with AI governance and emerging regulatory frameworks relevant to AI applications in collections and financial services operations.

• Demonstrated ability to provide clear, actionable legal guidance and to uphold a legal position in a dynamic business environment.

• Membership in the relevant state bar in good standing.

• Juris Doctor degree from an ABA accredited law school.

• Capable of managing multiple workstreams under tight deadlines.

• Excellent writing and verbal communication skills with business professionals and legal counsel.

• Proven history of collaborating effectively with business professionals and cross-functional teams (both internal and external).
