Senior Global Trade Counsel

This is a fully remote position, open to applicants in District of Columbia.

📋 Description

• Provide expert advice to business leaders and stakeholders regarding global trade issues impacting products, technology, transactions, supply chain, and operations.

• Offer legal counsel on U.S. and international export controls, economic sanctions, customs and import regulations, antiboycott statutes, and global trade laws.

• Evaluate geopolitical changes, regulatory measures, tariffs, trade remedies, and government policy initiatives; convey risks and suggested actions to senior management.

• Assist in commercial, supply-chain, product, and operational decision-making by identifying trade obligations and formulating risk-based solutions.

• Collaborate with the Legal Department on contracts, transactions, investigations, disclosures, and trade compliance issues.

• Guide export jurisdiction and classification for hardware, software, technology, technical data, and services under the EAR, ITAR, and non-U.S. regulations.

• Examine licensing requirements, license exceptions, exemptions, de-minimis and foreign direct product rules, reexports, retransfers, deemed exports, and access to controlled technology.

• Aid in export license applications, commodity classifications, advisory opinions, government filings, and monitoring of license conditions.

• Provide counsel on restricted-party, end-use, end-user, destination, diversion-risk, and sanctions screening; assess red flags and perform due diligence.

• Advise on Technology Control Plans and measures governing access to controlled technology, technical data, and facilities.

• Assist in investigations, voluntary and directed disclosures, enforcement actions, and government inquiries or audits.

• Counsel on customs classification, valuation, country of origin, marking, admissibility, foreign-trade zones, and import compliance.

• Review tariffs, Section 301 and Section 232 measures, antidumping and countervailing duties, forced-labor restrictions, and trade remedies.

• Collaborate with Logistics, Supply Chain, Finance, and external customs brokers on entry, clearance, post-entry, and duty matters.

• Support customs audits, protests, prior disclosures, ruling requests, and engagements with customs authorities.

• Enhance global trade compliance policies, procedures, controls, training, and governance practices.

• Develop risk-based processes for classification, licensing, screening, technology controls, import compliance, recordkeeping, and escalation procedures.

• Conduct or supervise compliance assessments, internal reviews, audits, risk analyses, and tracking of remediation efforts.

• Create and deliver focused training and communications.

• Advocate for consistent global standards while considering local legal requirements and operational realities.

• Promote trade compliance technology, automation, data analytics, and artificial intelligence initiatives.

• Represent Lumentum in dealings with government agencies, regulators, industry organizations, outside counsels, and external stakeholders.

• Keep abreast of legislative, regulatory, and enforcement changes and coordinate assessments of their impact along with business communications.

• Foster relationships throughout the organization and advocate for ethical, compliant, and commercially viable global trade practices.

• Contribute to the strategic priorities of the Legal Department and foster a culture of sound judgment, accountability, and ongoing improvement.

⛳️ Requirements

• Juris Doctor (J.D.) or an equivalent legal degree is required.

• Active bar membership in at least one U.S. jurisdiction is preferred.

• Over 15 years of experience in advising on international trade, export controls, economic sanctions, customs, or a related legal and compliance area.

• Experience in a multinational technology or manufacturing organization is strongly preferred.

• Proven expertise in the EAR, ITAR, OFAC sanctions, and U.S. customs laws.

• Familiarity with related non-U.S. trade systems is preferred.

• Practical experience with export classifications, licensing, deemed exports, technology-control programs, restricted-party screening, customs issues, trade remedies, investigations, and government inquiries.

• Strong understanding of how trade requirements intersect with product development, engineering, supply chain, manufacturing, logistics, sales, procurement, and commercial transactions.

• Exceptional legal judgment and capability to evaluate complex, incomplete, or rapidly evolving facts and provide clear, timely, actionable recommendations.

• Outstanding written, verbal, and executive communication abilities.

• Strong skills in relationship-building and influencing; adept at collaborating across functions, cultures, and jurisdictions.

• Self-motivated, pragmatic, and solutions-driven; capable of managing multiple priorities in a fast-paced global context.

• Fluency in English is mandatory.

• Proficiency in additional languages and experience working across Asia, Europe, or other international regions is advantageous.
