Senior Counsel – Employment, Litigation, and Investigations

This is a fully remote position, open to applicants in United States.

📋 Description

• Deliver strategic legal counsel for a healthcare organization operating across multiple states.

• Provide advice on compliance with healthcare regulations, privacy and security laws, fraud and abuse statutes, and licensing/accreditation requirements.

• Keep track of changes in healthcare legislation and regulatory requirements.

• Assist in the development of compliance policies and training programs.

• Evaluate the legal implications of various care delivery models, value-based programs, and new healthcare service projects.

• Prepare, review, and negotiate agreements related to vendors, providers, clinical services, administrative services, and technology.

• Counsel business executives on compliant healthcare partnerships, care coordination, and value-based care arrangements.

• Aid in the preparation of RFPs, partnership proposals, and sales documentation.

• Offer guidance on HIPAA, HITECH, and relevant state privacy regulations.

• Collaborate with Compliance and Privacy teams on regulatory risk assessments and audits.

• Address government inquiries or investigations as needed.

• Work alongside quality, network, compliance, finance, clinical, product, operations, and commercial teams.

• Act as a primary legal advisor to Commercial teams concerning strategic partnerships, value-based arrangements, and vendor integration.

• Oversee legal risks associated with commercial, provider, and vendor contracts.

• Facilitate product development and early-stage initiatives.

⛳️ Requirements

• Juris Doctor degree from an accredited law school.

• Active bar membership in good standing.

• Over 5 years of legal experience in an in-house or law firm setting.

• Extensive knowledge of healthcare fraud and abuse regulations, including AKS, Stark, and CMP.

• Familiarity with behavioral health care systems, Medicare Advantage, and risk adjustment methodologies.

• Experience with clinical integration, downstream provider contracting, and risk-based models.

• Capability to translate complex legal stipulations into practical, business-oriented solutions.

• Strong analytical, negotiation, and communication skills.

• Ability to align legal strategies with business objectives and understand operational implications.

• Must pass required background checks and a 10-panel drug screen upon hiring and throughout employment.

• Proficient in managing multiple projects and adhering to business deadlines.

• Ability to handle cross-departmental projects effectively.

• Self-motivated and able to work independently.

• Excellent relationship-building and communication skills across all organizational levels.

• Strong capabilities in reviewing, drafting, and negotiating complex contracts and legal documents.

• Ability to foresee and interpret regulatory changes and provide proactive compliance strategies.

• High-speed internet connection with a minimum of 20 Mbps download speed, 5 Mbps upload speed, and maximum latency of 100 ms.

• A quiet workspace with minimal background noise.

• Capability to work from home utilizing a computer and phone systems.

• Willingness to travel by air and stay overnight as necessary for business purposes.

• Must possess the legal right to work in the United States.
