This is a fully remote position, open to applicants in United States.
• Oversee federal and state healthcare regulations that impact MSO frameworks, the Corporate Practice of Medicine doctrine, the Anti-Kickback Statute, Stark Law, and telemedicine requirements across all 50 states.
• Monitor OIG advisory opinions, CMS directives, DEA regulations concerning controlled substances, and updates from state medical boards.
• Manage a compliance calendar that tracks regulatory deadlines, license renewals, and credentialing obligations.
• Perform quarterly compliance audits of Brand Partner agreements, IMG frameworks, and payment methodologies.
• Assess and confirm Fair Market Value compensation structures for physician services.
• Collaborate with independent third-party valuators to establish and document FMV rates.
• Audit payment processes to ensure compensation is independent of outcomes.
• Document compliance with safe harbor provisions under 42 C.F.R. § 1001.952(d)(1) for all MSO arrangements.
• Maintain compliance matrices for CPOM requirements in stringent states.
• Keep track of state-specific telemedicine regulations and physician licensing requirements.
• Analyze state medical practice acts and corporate structure regulations.
• Work with state healthcare attorneys on jurisdiction-specific matters.
• Review Brand Partner Agreements, Management Services Agreements, and Business Associate Agreements to ensure compliance.
• Ensure that clinical autonomy provisions are adequately documented and upheld.
• Audit physician employment agreements within the IMG structure.
• Maintain a compliance documentation library and audit trail.
• Supervise the physician licensing and credentialing processes across all 50 states.
• Monitor DEA registrations related to controlled substance prescribing authority.
• Keep an eye on medical malpractice insurance coverage and limits.
• Collaborate with the IMG medical director on physician compliance issues.
• Develop compliance guidance materials for Brand Partners regarding marketing claims, HIPAA standards, and prohibited activities.
• Conduct onboarding compliance training for new Brand Partners.
• Investigate potential compliance breaches and suggest corrective measures.
• Offer guidance on structural separation between business and medical functions.
• Prepare quarterly compliance reports for executive leadership.
• Identify compliance risks and formulate strategies to mitigate them.
• Maintain a compliance metrics dashboard.
• Collaborate with external healthcare law firms on complex compliance inquiries.
• Bachelor's degree in Healthcare Administration, Public Health, Legal Studies, or a related field.
• At least 5 years of healthcare compliance experience, ideally with MSO frameworks, physician groups, or telehealth companies.
• In-depth knowledge of the Corporate Practice of Medicine doctrine, Anti-Kickback Statute, Stark Law, and HIPAA regulations.
• Experience with state-specific healthcare regulatory variations and multi-state compliance.
• Demonstrated success in conducting compliance audits and developing compliance programs.
• Strong understanding of Fair Market Value methodologies in healthcare agreements.
• Experience with telemedicine regulatory compliance and the Ryan Haight Act requirements.
• Background in private equity healthcare transactions or MSO structures.
• Familiarity with physician credentialing and state medical board regulations.
• Knowledge of OIG advisory opinions and trends in healthcare fraud enforcement.
• Exceptional attention to detail and the ability to identify compliance risks proactively.
• Strong analytical skills to interpret complex healthcare regulations and apply them to business operations.
• Excellent written communication skills for policy creation and compliance documentation.
• Ability to collaborate across legal, medical, and business operations teams.
• Comfortable with ambiguity and capable of developing practical compliance solutions in a changing regulatory environment.
• Project management skills to coordinate multi-state compliance efforts.
• Proficient in compliance management software, document management systems, and Excel for tracking and reporting purposes.
