Litigation Attorney – Commercial Real Estate

This is a fully remote position, open to applicants in New York.

📋 Description

• Examine ongoing commercial real estate disputes and formulate effective litigation strategies.

• Collaborate on cases involving leases, transactions, development, landlord–tenant conflicts, zoning, financing, and security interests.

• Utilize substantive U.S. law and practical litigation judgment in intricate factual situations.

• Sustain a consistent litigation approach as facts and opposing arguments change.

• Recognize legal and procedural challenges that significantly impact case strategy.

• Compose motions, briefs, demand letters, and discovery documentation.

• Generate legal documents that adhere to professional litigation standards and appropriate legal language.

• Construct arguments based on relevant law, factual context, and case theory.

• Counter opposing positions through compelling written advocacy.

• Deliver detailed outputs under the guidance of senior personnel.

• Ensure continuity in case theory, factual representation, and litigation stance throughout various stages.

• Modify arguments as new data, opposing submissions, or strategic factors arise.

• Efficiently integrate senior feedback while maintaining consistency and implementing targeted modifications.

• Create structured rubric items in conjunction with litigation drafts.

• Establish criteria for assessing responses to submissions from opposing counsel.

• Identify key legal issues, reasoning steps, and drafting components expected in high-caliber work.

• Apply uniform evaluation criteria across intricate litigation scenarios.

• Recognize procedural uncertainties, factual ambiguities, and absent information.

• Highlight issues that necessitate clarification from senior reviewers or project leads.

• Differentiate between reasonable assumptions and matters needing escalation.

• Assess the necessity for additional facts or legal authorities before proceeding with a position.

⛳️ Requirements

• Active or lapsed license as a U.S. attorney, with admission in at least one U.S. jurisdiction.

• A minimum of 3 years of post-JD litigation experience.

• Strong proficiency in drafting, discovery, and motion practice, rather than solely transactional work.

• Proven experience managing commercial real estate disputes.

• Familiarity with leases, development, landlord–tenant matters, zoning, transactions, financing, or security interests.

• Demonstrated capability to draft intricate litigation documents under the guidance of senior or partner-level attorneys.

• Solid understanding of case theory, litigation strategy, and procedural analysis.

• Exceptional written English skills and mastery of professional legal drafting.

• Experience at a BigLaw, boutique, or mid-market firm is preferred.

• Exposure to various types of commercial litigation matters is advantageous.

• Federal court commercial litigation experience is a plus.

• Previous involvement in AI-related legal projects is beneficial but not mandatory.

• Open to candidates based in the U.S.

• Capability to commence initial tasks within approximately 24-48 hours after onboarding completion.

• Work must be executed without utilizing confidential or proprietary information from any employer, client, law firm, institution, or other third parties.
