This is a fully remote position, open to applicants in Nebraska.
• Provide guidance to physicians, physician groups, ASCs, specialty hospitals, and various healthcare providers regarding regulatory compliance, including matters related to the Stark Law, the Anti-Kickback Statute, and the False Claims Act.
• Structure, draft, and negotiate physician employment agreements, professional services contracts, medical director agreements, and joint venture arrangements.
• Offer counsel to clients on Medicare reimbursement rules and regulations, including participation conditions, billing compliance, and payor contracting considerations.
• Advise on HIPAA compliance, healthcare privacy, data security requirements, breach response protocols, and applicable state privacy laws.
• Analyze and provide insights on corporate governance, organizational structure, and operational compliance for healthcare entities.
• Represent individual healthcare providers in professional discipline cases before the Nebraska Department of Health and Human Services and other state licensing boards.
• Manage professional licensure investigations and proceedings, medical staff credentialing and privileging disputes, peer review and fair hearing processes, hospital and health system employment issues, as well as graduate medical education program disputes.
• Conduct due diligence and offer regulatory analysis for healthcare transactions, including acquisitions, affiliations, and practice formations.
• Build and sustain strong client relationships while serving as a trusted advisor.
• Contribute to initiatives aimed at developing the practice group.
• Collaborate virtually with colleagues and clients within the fully remote Health Law Practice Group.
• Juris Doctor degree from an ABA-accredited law school with a robust academic record.
• At least 6 years of health law experience in a law firm environment, with significant exposure to provider-side regulatory and transactional matters.
• Proven understanding of federal healthcare regulatory frameworks, including the Stark Law, Anti-Kickback Statute, False Claims Act, and HIPAA privacy and security regulations.
• Familiarity with Medicare rules and reimbursement regulations, covering conditions of participation and billing compliance requirements.
• Knowledge of Nebraska state medical licensing statutes and regulations; experience with other state licensing frameworks is preferred.
• Experience in advising physicians, physician groups, ambulatory surgery centers, and other healthcare providers on regulatory compliance and transactional issues.
• Excellent written and verbal communication skills.
• Strong analytical and problem-solving skills, sound judgment, and keen attention to detail.
• Demonstrated ability to manage multiple matters and priorities while delivering high-quality work within deadlines.
• A collegial, team-oriented mindset and a commitment to mentoring junior attorneys.
• Must be comfortable and effective in a fully remote work environment, including virtual collaboration with colleagues and clients.
• Active bar membership in Nebraska, or eligibility for admission to the Nebraska bar.
• Attorneys licensed in other jurisdictions should be willing to obtain Nebraska bar admission within a reasonable timeframe.
