This is a fully remote position, open to applicants in United States.

📋 Description

• Provide expert guidance on the design, implementation, and management of health and welfare benefit programs, which encompass medical, dental, vision, life, disability, EAP, wellness, cafeteria plans, and FSAs/HSAs/HRAs.

• Advise clients on adherence to ERISA, ACA, COBRA, HIPAA, MHPAEA, and other pertinent federal and state regulations that influence group health plans.

• Create, review, and revise plan documents, SPDs, SBCs, mandatory notices, and employee communications.

• Offer advice on plan governance and fiduciary compliance, including oversight frameworks, committee practices, and documentation protocols.

• Manage vendor and service provider contracts for health and welfare plans, including the review and negotiation of terms.

• Assist clients in addressing claims, appeals, audits, and inquiries from DOL, IRS, HHS, and state insurance authorities.

• Conduct benefits-related due diligence in M&A activities and provide guidance on plan integration, transition, or termination.

• Stay informed on regulatory changes and guidance, translating them into actionable implementation strategies.

• Collaborate with HR, benefits, legal, and finance teams to formulate and execute compliant, employee-centric benefits strategies across various sectors.


⛳️ Requirements

• A minimum of three years of relevant legal experience in employee benefits/ERISA law, with a strong emphasis on health and welfare plans.

• In-depth knowledge of ERISA, the Internal Revenue Code, ACA, COBRA, HIPAA, MHPAEA, and other federal and state laws affecting group health plans.

• Experience with ERISA plan governance mandates, including the drafting and upkeep of plan documents, SPDs, and required notices, as well as advising on fiduciary processes for health and welfare plans.

• Background in reviewing M&A due diligence and providing counsel on health and welfare plan matters in corporate transactions.

• Proven track record in negotiating and overseeing health and welfare vendor agreements, including TPAs, PBMs, stop-loss, wellness programs, networks, and consultants.

• Exceptional analytical, drafting, and negotiation capabilities.

• Proficiency in articulating complex benefits regulations in straightforward, practical terms.

• Capability to work both independently and collaboratively with HR, benefits, finance, and legal teams.

• High ethical standards, professional integrity, sound judgment, and risk-assessment abilities.

• Must be licensed and in good standing to practice law in your primary state of residence.

• Required legal authorization to work.

• Completion of a background check and proof of identity may be necessary.
