This is a fully remote position, open to applicants in California.
• Oversee and direct all facets of litigation related to restrictive covenants, errors and omissions, and contractual disagreements from the initial strategy stage through to resolution, including trials or hearings.
• Represent the company in court to present motions, participate in hearings, and conduct trials as necessary.
• Offer strategic guidance on hiring and onboarding processes, including assessments of pre- and post-hire risks and strategies for mitigation.
• Secure or contest temporary restraining orders and preliminary injunctions in disputes involving restrictive covenants, often on an expedited or emergency basis.
• Draft, review, and negotiate legal documents pertinent to disputes and settlements.
• Select, hire, and oversee external counsel; manage budgets, strategies, and case outcomes.
• Counsel business leaders on litigation risks, strategies for dispute avoidance, and enforcement of contracts.
• Develop and implement strategies for arbitration and alternative dispute resolution.
• Collaborate with Legal, Finance, and Operations teams to identify risks early and align with business goals.
• Prepare regular updates and reports on litigation for executive leadership.
• Contribute to litigation protocols and the management of e-discovery systems.
• Keep abreast of legal trends and regulatory changes that may impact the company's litigation exposure.
• Work with the General Counsel on litigation strategies, prioritization, and resource allocation.
• Juris Doctor degree from an accredited institution.
• Active license and in good standing in at least one U.S. jurisdiction.
• A minimum of 8 years of pertinent litigation experience, including experience with restrictive covenant litigation.
• Significant hands-on experience in obtaining or defeating temporary restraining orders and preliminary injunctions in expedited proceedings.
• Experience in the insurance industry is preferred.
• Ability to manage internal litigation and investigations while effectively overseeing outside counsel.
• Demonstrated capability to advocate successfully in court and other legal settings.
• Ability to think strategically while evaluating economic, legal, and reputational risks to the organization.
• Capacity to devise innovative and compliant solutions for complex issues.
• Exceptional organizational and analytical skills.
• Ability to prioritize and handle multiple issues involving business partners across various locations.
• Highest standards of judgment, ethical conduct, and integrity.
• Strong self-motivation, strategic thinking, and meticulous attention to detail.
• Must comply with applicable state insurance licensing requirements for positions that necessitate a state insurance license; must not be disqualified or barred from licensure or prohibited under Title 18 U.S. Code §§1033 and 1034.
