This is a fully remote position, open to applicants in United States.
• Act as the firm’s leading authority on firm-level licensing with the CFTC and NFA.
• Navigate the business through the complete registration process and the changing regulatory environment of the Commodity Exchange Act (CEA).
• Offer essential legal advice on OTC and cleared derivatives, margin lending, and privacy issues related to new business initiatives.
• Collaborate with Trading, Operations, Risk, and Engineering teams to integrate CFTC/NFA compliance requirements into trading processes and platform design.
• Keep track of changes in CFTC directives and NFA interpretive notices, providing the executive team with guidance on necessary adjustments to business strategies.
• Oversee the legal response to regulatory inquiries and NFA audits, coordinating preparation, documentation, and strategic communications with regulators.
• Serve as a key individual contributor on intricate projects, including the introduction of new derivative asset classes and managing cross-border regulatory changes.
• Lead the creation of internal 'Rules-to-Workflow' frameworks to avert regulatory violations.
• J.D. degree with a specialization in financial services, commodities, or corporate law.
• A minimum of 4 years of legal practice, with at least 3 years concentrated on CFTC and NFA regulatory issues.
• Extensive knowledge and hands-on experience with the Commodity Exchange Act (CEA) and the Dodd-Frank Act (Title VII).
• Strong technical understanding of derivatives, including a comprehensive grasp of OTC products, margin lending, and the legal lifecycle of futures and swaps.
• Exceptional communication, drafting, and negotiation abilities, with specific experience in handling ISDA/CSA documentation or clearing agreements.
• Proven track record of collaborating closely with business and cross-functional teams (Trading, Engineering, and Risk) to develop new financial products, address complex jurisdictional challenges, and plan for scalability.
• Passion for cryptocurrency and a foundational comprehension of how digital assets relate to CFTC/NFA jurisdiction and the shifting global regulatory landscape.
• Demonstrated attention to detail with the capacity to manage intricate licensing applications and regulatory audits simultaneously.
• Ability to execute tasks with moderate supervision, balancing ambitious commercial growth goals with the need for strict legal and regulatory adherence.
• Previous in-house legal experience at a fintech company, hedge fund, major financial institution, or within a specialist regulatory practice at a top-tier law firm.
• Knowledge of market infrastructure, including electronic trading systems, central clearing, and the operational intricacies of margin and collateral management.
