This is a fully remote position, open to applicants in United States.
• Provide legal assistance at the crossroads of healthcare technology, cybersecurity, data privacy, and regulatory compliance.
• Offer guidance on legal matters, draft and negotiate contracts, ensure adherence to compliance, manage risks, and negotiate technology and security terms.
• Advise the business on HIPAA, HITECH, and other privacy and security obligations.
• Support broader commercial contracting and legal-risk concerns impacting Availity’s healthcare technology platform.
• Draft, evaluate, and negotiate healthcare technology contracts and provisions related to cybersecurity.
• Collaborate with Information Security on incidents, threats, vulnerabilities, and risk management efforts.
• Ensure adherence to federal and state healthcare regulations, including HIPAA, HITECH, and other privacy and security laws.
• Keep abreast of changes in cybersecurity and privacy regulations, translating developments into guidance, policies, and contractual standards.
• Provide legal risk assessments to business and technical stakeholders based on intricate technical findings.
• Oversee compliance with payer requirements and regulations impacting revenue cycle management.
• Identify and mitigate legal risks associated with healthcare technology, revenue cycle management operations, and litigation issues.
• Develop and implement policies and procedures to manage and reduce legal risks.
• Handle and resolve legal disputes, including contract disagreements, regulatory inquiries, and litigation.
• Offer guidance and assistance to internal teams regarding legal obligations.
• Collaborate with compliance, finance, operations, and other departments.
• Provide legal insights in strategic planning and business development efforts.
• Report to the Associate General Counsel.
• A minimum of 3 years of experience at a law firm as a corporate or transactional associate and/or as an in-house corporate or transactional attorney.
• Proven experience advising on cybersecurity incidents, incident response, digital forensics findings, remediation strategies, and related legal and contractual risks.
• Experience in the healthcare and/or information technology sector is highly preferred.
• Familiarity with clearinghouse or Revenue Cycle Management is an advantage.
• Juris Doctorate (JD) from an accredited law school.
• Active membership in good standing in at least one U.S. state bar.
• Knowledge or experience in healthcare law, technology law, cloud computing, SaaS, software licensing agreements, data privacy, HIPAA/HITECH, state privacy and breach-notification laws, recognized security frameworks, Omnibus and other related laws, accreditations, and software and technology regulations.
• Experience in drafting, reviewing, and negotiating healthcare technology contracts, including information-security addenda, business associate agreements, data-protection clauses, software agreements, licensing contracts, service agreements, and cybersecurity provisions.
• Ability to work efficiently in a fast-paced environment.
• Skill in evaluating technical security information and translating it into legal risk assessments and actionable business recommendations.
• Strong organizational and time management capabilities.
• Ability to adapt to shifting priorities while demonstrating initiative, accountability, and leadership.
• Strategic and analytical thinking ability.
• Strong decision-making skills.
• Preferred experience collaborating with information security, privacy, compliance, technology, and operational teams.
• Preferred experience advising a healthcare technology company, healthcare clearinghouse, health plan, or other regulated technology organization.
• Preferred experience managing legal responses to third-party or customer cybersecurity incidents.
• Preferred knowledge of healthcare interoperability, electronic data exchange, and revenue-cycle management operations.
• Relevant privacy or cybersecurity certification, such as CIPP/US, CIPM, or comparable credential, is preferred.
• Preferred experience in commercial contracting within a healthcare technology company.
• Ability to use a camera for all virtual meetings.
