Compliance Attorney – Regulatory & Legislative Strategy

This is a fully remote position, open to applicants in Florida.

📋 Description

• Serve as the primary legal and regulatory advisor for public-sector clients concerning employer-sponsored health and welfare plans.

• Implement federal laws applicable to governmental plans, such as ACA (4980H), HIPAA, COBRA, MHPAEA, the No Surprises Act, RxDC reporting, and Transparency in Coverage.

• Provide guidance on Florida-specific regulations, including Chapter 112 provisions, Sunshine Law implications, and public board approval processes.

• Oversee the compliance calendar for the company’s group health plans and manage compliance-related deadlines.

• Supervise 1094/1095-C reporting strategies, variable hour assessments, and measurement period policies.

• Direct HIPAA Privacy/Security initiatives, which include conducting risk assessments, coordinating incident responses, and providing training.

• Create and present specialized training programs for HR teams, boards, and unions.

• Develop proprietary templates, checklists, model policies, and decision memos.

• Track federal and state legislative, regulatory, and judicial changes, and issue actionable client alerts.

• Review, edit, negotiate, and finalize various agreements, including client services agreements, HIPAA BAAs, TPA/ASO contracts, vendor and consultant agreements, and stop-loss carrier agreements/policies.

• Act as a strategic subject matter expert in RFP proposal responses and finalist meetings.

• Serve as a liaison between the Brown & Brown Legal Team and the Public Sector Practice Group.


⛳️ Requirements

• A minimum of 10–15 years of experience in employee benefits compliance, ERISA (and non-ERISA governmental plan) law, or senior-level benefits consulting.

• Required: Bachelor’s Degree in Business Administration, Human Resources, Public Administration, or a related field.

• At least 3 years of direct experience working with governmental entities, such as cities, counties, or school boards.

• Familiarity with Florida Chapter 112 (Public officers and employees).

• Understanding of Sunshine Law & Public Records compliance.

• Knowledge of governmental procurement/RFP cycles.

• Demonstrated success in delivering "Summit-level" presentations or webinars to large audiences (100+ attendees).

• Experience in "finalist meetings" or oral presentations as a technical subject matter expert to secure new business.

• Extensive experience in reviewing and redlining ASO, TPA, and PBM contracts.
