Senior Legal Counsel VP – Vendor Contracts, Privacy

This is a fully remote position, open to applicants in Arizona, +5 more states.

📋 Description

• Deliver legal assistance for data privacy, data protection, and cybersecurity initiatives, including procedures, training, and guidance.

• Evaluate and monitor internal data protection policies and procedures.

• Aid in managing data subject access requests and security incidents.

• Counsel business line partners on data protection and privacy regulations, compliance, and information security best practices.

• Facilitate regulatory change management within the financial services sector.

• Provide updates and insights on the implications of new and evolving laws.

• Review, draft, modify, and negotiate agreements with vendors, clients, third parties, sub-processors, technology providers, and licensing arrangements.

• Draft and negotiate contractual clauses related to data protection.

• Ensure the appropriate language is used when Pathward operates as a data controller or data processor.

• Advise on agreements, risk mitigation strategies, and adherence to company policies and legal standards.

• Collaborate with stakeholders across IT, Information Security, People & Culture, Treasury, and other business divisions.

• Execute additional legal support tasks as assigned by the Deputy General Counsel and Chief Privacy Officer.

⛳️ Requirements

• Juris Doctor degree is mandatory.

• Must hold an active membership to practice law in at least one U.S. state.

• Over 7 years of legal experience as a practicing attorney in large law firms, governmental agencies, and/or in-house legal/compliance departments.

• Strong preference for candidates with proven knowledge and experience in the financial services industry and with publicly traded companies.

• Extensive experience in analyzing, interpreting, and applying state and federal regulations to vendor contracts and privacy programs.

• Working knowledge of privacy-related regulations relevant to financial institutions.

• Experience in drafting complex technology and BaaS agreements.

• Proficient in Microsoft Office 365 (Word, PowerPoint, Excel, Outlook, Teams).

• Exceptional written and verbal communication abilities.

• Familiarity with privacy and data protection principles.

• Capability to assess and manage legal risks in third-party relationships.

• Aptitude for building relationships and influencing stakeholders across business lines.

• Ability to work independently.

• Willingness and adaptability to respond to changing privacy regulations, vendor risk requirements, and organizational needs.
