Senior Counsel

This is a fully remote position, open to applicants in United States.

📋 Description

• Deliver daily legal advice and counsel to internal stakeholders, including Compliance, Legal, Operations, and Digital Technology.

• Act as a subject matter expert on US data privacy and data security laws and regulations, covering both federal and state privacy and consumer protection statutes.

• Offer legal guidance on data privacy, data governance, and data security matters, including compliance, privacy impact assessments, and training, while keeping abreast of evolving legal, regulatory, and enforcement trends to support timely updates to internal privacy compliance programs and procedures.

• Provide proactive legal counsel and training on data privacy, technology, and data governance, including considerations for emerging AI and machine learning applications.

• Examine new laws and regulations related to data privacy, data governance, and data security, advising on potential regulatory and contractual impacts.

• Stay updated on the latest cyber best practices to ensure consistent alignment of the cyber compliance framework.

• Assist the government relations team with issues related to data privacy, data governance, and data security.

• Help provide legal coverage during regulatory examinations.

• Offer legal support and advice on data security incidents, including data response/preparedness, compliance with data breach notification laws, third-party breach responses, client inquiries, and client-facing documentation.

• Review, analyze, draft, and negotiate vendor contracts, including data processing agreements and clauses related to data privacy, governance, and security, among others.

• Oversee and provide ongoing advice on information governance concerns, such as litigation holds, document retention, and destruction policies.

⛳️ Requirements

• Juris Doctorate from an accredited institution.

• At least 7 years of professional experience as a practicing attorney specializing in privacy and information management, including in-house, regulatory agency, or law firm experience, or a combination thereof.

• Active member in good standing with the State Bar.

• Proven extensive legal experience in advising on relevant federal and state data privacy and data security laws (e.g., GLBA, HIPAA, NYDFS Cybersecurity Regulation), ideally within an insurance company or another highly regulated sector.

• Strong comprehension of current legal and regulatory requirements regarding data privacy and data security, along with related legal landscapes, especially pertaining to insurance companies and financial institutions.

• Significant experience in leading negotiations and drafting contracts for technology products, including those incorporating AI features.

• Excellent analytical, problem-solving, and legal research abilities.

• Strong business acumen, strategic thinking, and client counseling proficiency.

• Demonstrated capability to independently identify issues, analyze challenges, and propose actionable solutions.

• Exceptional verbal, written, interpersonal, organizational, and negotiation skills.

• Ability to effectively communicate and interact with personnel and management at all levels, including senior executives.

• Capacity to follow up on tasks promptly, exercise sound business judgment, and maintain accuracy under pressure.

• CIPP certification is preferred.
