This is a fully remote position, open to applicants in California.
• The main responsibility is to support house counsel with various pre-trial activities; prepare responses, motions, and other legal documents; conduct research and gather information for claim cases; and communicate with clients to investigate facts for trial preparation.
• Collects, organizes, and summarizes relevant information from diverse sources to prepare responses to discovery requests.
• Engages in correspondence with clients, attorneys, claims personnel, and other relevant parties to discuss case status, gather additional pertinent information, and address routine inquiries about legal procedures.
• Generates a wide range of written documents using advanced word processing software; obtains necessary extensions to ensure all objections are preserved and responses are completed accurately and on time; prepares legal briefs, pleadings, appeals, and motions for attorney review and use.
• Drafts letters and legal documents; prepares, organizes, and formats court documents, discovery materials, and any other pleadings as directed.
• Files pleadings, prepares affidavits of documents, and maintains digital files within the case management system.
• Completes special legal assignments to aid in managing claim cases.
• Prepares initial drafts of administrative reports including initial opinions, discovery summaries, medical record summaries, and pre- and post-trial reports as instructed.
• Demonstrates the ability to prioritize and reprioritize tasks to ensure timely completion of assignments while managing day-to-day activities logically and effectively.
• Assists the attorney in trial preparations, including assembling and identifying exhibits, trial books, motions in limine, expert witness lists, statements of the case, and other necessary trial documents.
• Conducts research and analysis of legal sources such as statutes, recorded judicial decisions, legal articles, depositions, and legal codes.
• Investigates facts and case law to identify causes of action and support case preparation.
• Aids the insured in Small Claims cases by investigating facts to prepare trial briefs, preparing the insured for trial, attending trials with the insured, and defending the company when named as a party to the action.
• Collects and assesses all evidence related to the case, contacting relevant parties for information, and preparing for hearings; researches applicable statutes or case law, vehicle valuations, medical treatments, aerial maps, and policy language to support the defense in Small Claims actions.
• Completes a minimum of 4 hours of continuing education or the required educational hours in accordance with state regulations.
• Minimum: Completion certificate from a paralegal program approved by the American Bar Association;
• A certificate from a paralegal program or a degree from a postsecondary institution requiring the successful completion of at least 24 semester or equivalent units in law-related courses, accredited by a national or regional accrediting organization or approved by the Bureau for Private Postsecondary and Vocational Education;
• BA or an advanced degree in any field, along with at least one year of law-related experience under the supervision of an attorney who has been an active member of the State Bar of California for at least the last three years or has practiced in the federal courts of the state for at least the last three years, including a written declaration from this attorney affirming the individual's qualifications to perform paralegal tasks;
• Alternatively, a high school diploma or general equivalency diploma, with a minimum of three years of law-related experience under the supervision of an attorney with similar qualifications, along with a written declaration from this attorney stating the individual's qualifications to perform paralegal tasks.
• This experience and training must be completed no later than December 31, 2003.
• Preferred: Degree in paralegal studies and/or Paralegal Certificate with 1+ years of insurance defense or civil litigation experience.
• Minimum: 0-2 years of experience as an insurance defense paralegal and/or equivalent insurance defense litigation experience.
• Preferred: 1-2+ years of paralegal experience in civil litigation or insurance defense.
• Minimum: General knowledge of legal principles, terminology, and procedures; strong written communication skills to draft legal documents in support of and responses to discovery, depositions, and motions as well as to proofread and edit documents for accuracy. Must be able to work in a paperless environment and effectively communicate with clients, attorneys, and other involved parties.
• Preferred: Excellent verbal and written communication and grammatical skills to draft motions, oppositions, and replies; ability to execute daily tasks logically and effectively, ensuring timely completion of work assignments.
