Litigation Attorney – Auto BI/PD

This is a fully remote position, open to applicants in Texas.

📋 Description

• Oversee and litigate Bodily Injury and certain Property Damage claims, which include first-party property claims, subrogation, and bad faith litigation.

• Act as the company's representative throughout all litigation phases, from pre-suit investigations to trial and post-trial processes.

• Formulate case strategies, draft legal documents such as pleadings and motions, conduct discovery, and participate in depositions, mediations, hearings, and trials.

• Offer expert legal counsel to the claims department, management, and other internal teams.

• Ensure all actions taken during the claims process adhere to relevant laws and regulations.

• Advise on legal risks concerning policy interpretations, claims settlements, and potential liabilities.

• Negotiate settlements on behalf of the company efficiently and cost-effectively.

• Engage in mediations, arbitrations, and settlement negotiations.

• Perform comprehensive legal research on property damage, insurance laws, and regulations in Texas, including recent judicial decisions and legislative changes.

• Draft clear, concise, and compelling legal documents, including briefs, memoranda, and legal opinions.

• Stay informed about updates in insurance and bodily injury/property damage laws in Texas, ensuring the company's compliance with local, state, and federal legislation.

• Assist in formulating policies and procedures to reduce legal risk and enhance operational efficiency.

• Collaborate with the claims department, adjusters, and other legal teams to offer proactive and responsive legal support.

• Effectively communicate intricate legal concepts and strategies to non-legal staff in a clear manner.

⛳️ Requirements

• Juris Doctor (JD) degree from an accredited law institution.

• Admission to the Texas Bar and in good standing.

• Bilingual proficiency in English and Spanish is highly preferred.

• Strong grasp of insurance laws and regulations.

• Capability to analyze intricate legal issues and devise effective strategies.

• Proficient in legal research tools and case management software.
