Senior Litigation Counsel

This is a fully remote position, open to applicants in Texas.

📋 Description

• Oversee all aspects of commercial litigation, from pre-suit investigation to pleading, discovery, trial, and post-judgment enforcement.

• Manage intricate disputes related to MCA agreements, commercial guarantees, merchant defaults, stacking issues, and payment processor conflicts.

• Develop and implement recovery strategies, including bank restraints, property liens, wage garnishments, fraudulent conveyance actions, and post-judgment subpoenas.

• Prepare pleadings, emergency motions, summary judgment motions, and appellate briefs.

• Advocate for clients during oral arguments, hearings, depositions, mediations, and trial proceedings.

• Counsel lenders, funding companies, and financial institutions on risk management, portfolio recovery, and compliance with changing state and federal commercial finance regulations.

⛳️ Requirements

• Must hold a license in the state of Texas and reside in Houston or nearby areas.

• Juris Doctor (JD) degree from an accredited law school is required.

• Active bar admission in good standing within the primary operating jurisdiction.

• A minimum of 5 years of focused experience in commercial litigation, particularly in MCA litigation, debt collection, and creditors’ rights.

• Comprehensive knowledge of Uniform Commercial Code (UCC) Articles 3 and 9.

• Understanding of state judgment enforcement procedures and commercial contract law.

• Proven history of motion practice, trial experience, and emergency relief hearings.

• Capability to independently manage a substantial caseload while ensuring meticulous attention to detail in a dynamic environment.

• Familiarity with bankruptcy proceedings is advantageous.

• Experience with regulatory changes impacting the MCA and alternative finance sector is preferred.
