This is a fully remote position, open to applicants in United States.
• Perform a strategic, high-volume evaluation of advertising and promotional claims, product labeling, and marketing assets across various platforms including web, email, social media, paid media, and packaging to ensure compliance with FDA, FTC, and state consumer protection regulations.
• Assess proposed claims for compliance with FDA labeling and promotion, while coordinating with Regulatory Affairs on claim substantiation, off-label risks, and FDA guidance.
• Develop practical legal tools that integrate claim substantiation and consumer protection compliance into the marketing development cycle.
• Act as a primary legal liaison to Regulatory Affairs, Clinical, Quality, Medical, Product, and Marketing teams regarding claims and compliance issues.
• Assist in the legal review of clinical trials and research projects that inform marketing claims.
• Collaborate with cross-functional legal teams to stay updated on changes in FDA and FTC advertising and promotion regulations, clinical research, and consumer protection law, converting these insights into actionable guidance.
• Report directly to the Head Counsel, Product.
• Juris Doctor degree from an ABA-accredited law school.
• Active bar membership in at least one US jurisdiction and eligible to practice in-house in your state of residence.
• Over 5 years of experience in a law firm and/or in-house legal role.
• Significant experience in reviewing advertising and promotional claims, preferably for products regulated by the FDA.
• Solid understanding of FDA and FTC advertising and promotion regulations and claim substantiation standards.
• Capable of making sound, practical decisions swiftly in a dynamic, fast-paced environment with changing priorities.
• Strong communication and relationship-building skills with cross-functional stakeholders.
• Ability to balance legal risks with business goals and propose creative, feasible solutions.
• Detail-oriented, self-motivated individual comfortable navigating ambiguity and new legal challenges.
• Preferred: experience in supporting clinical trials, research, or MLR review.
• Preferred: in-house experience within a healthcare, pharmaceutical, medical device, consumer health, or telehealth organization.
• Preferred: familiarity with clinical data and real-world evidence as a foundation for claim substantiation.
• Preferred: background in consumer goods, health technology, or digital product ecosystems.
• Preferred: experience providing counsel on AI-powered products.
• Annual base salary ranging from $215,000 to $255,000.
