This is a fully remote position, open to applicants in United States.
• Prepare, evaluate, and negotiate contracts with payment service providers, acquirers, card networks, payment facilitators, banks, and other financial collaborators.
• Provide guidance on comprehensive payment processing operations, covering payment methods and providers, global money transfers and settlements, chargebacks, refunds, fund flows, and reserve/holdback arrangements.
• Offer advice and assistance on KYC/KYB, AML/CFT, sanctions screening, and customer due diligence obligations across various markets.
• Support legal and regulatory compliance for integrating with payment systems and entering new markets, including licensing assessments and entity structuring.
• Counsel the business on legal considerations and implications of business choices, initiatives, and payment strategies.
• Keep up-to-date with laws and regulations related to payment services and digital advancements, including cryptocurrencies, blockchain, NFTs, and decentralized finance (DeFi).
• Evaluate the effects of new and proposed regulations on money movement, payment strategies, and business initiatives.
• Draft, assess, and negotiate agreements and documentation for new business concepts, licensing, vendor, and partnership arrangements.
• Collaborate closely with business and technology teams to create compliant payment products and service offerings.
• Identify potential legal risks and suggest effective solutions.
• Manage various priorities, adhere to tight deadlines, and provide additional legal services and counsel as required.
• Admitted to practice law in the US, maintaining good standing.
• Minimum of 5 years of legal experience in fintech, banking, and/or payments.
• Proven expertise in payments and an understanding of the relevant U.S. and international regulatory framework, including money transmission, BSA/AML, PSD2, MiCA, and card network regulations.
• Established capability to provide practical legal counsel in a dynamic business setting.
• Strong communication skills and the ability to work effectively with cross-functional teams, including product, technology, business operations, and management.
• Superior drafting abilities.
• Experience in drafting, reviewing, and negotiating intricate commercial agreements, encompassing payment processing, financial services, technology, licensing, vendor, and partnership contracts.
