This is a fully remote position, open to applicants in Utah.
• This opportunity is a project-based consulting engagement rather than a part-time position.
• There are no predetermined hours associated with this role.
• Evaluate marketing materials, website content, social media, and advertising copy to ensure that health and treatment assertions align with FTC and FDA regulations prior to publication.
• Provide guidance on acceptable language for supplement and medical service claims.
• Develop a streamlined review procedure to ensure that content is legally vetted before it becomes public.
• Examine existing HIPAA compliance measures concerning patient intake, records management, and data handling practices.
• Review agreements with vendors and partners to ensure they include suitable data privacy clauses.
• Offer advice on patient consent procedures and standards for documentation.
• Inspect supplement product labeling, claims, and documentation for compliance with FDA regulations under DSHEA.
• Provide counsel on allowable structure/function claims.
• Identify ingredients or formulations that may require NDI notification or further investigation.
• Advise on the regulatory limits of treatments, protocols, and provider representations to ensure that clinical operations remain within the appropriate legal and professional frameworks.
• Review materials intended for patients and communications with providers for language that could pose liability risks or attract regulatory attention.
• Identify emerging areas of risk as the clinic's service offerings continue to evolve.
• Juris Doctor (J.D.) with active bar admission (or recently inactive) and a background in health law, FDA/FTC regulations, or healthcare compliance.
• Proficient understanding of HIPAA, FTC health claim enforcement, DSHEA, and the regulatory frameworks governing medical practices.
• Experience in advising clients or employers on health and wellness regulatory issues — not merely researching the law, but providing actionable recommendations.
• Ability to deliver clear and direct guidance to non-legal teams: not just outlining risks, but advising on appropriate actions.
• Comfortable working autonomously without institutional support.
• Bonus: Experience providing counsel to direct-to-consumer health companies, supplement brands, or medical practices concerning marketing compliance.
• Background in regulatory environments related to integrative, functional, or regenerative medicine.
• Familiarity with state-specific medical practice laws in Utah or compliance with multi-state telehealth regulations.
• Previous experience in fractional, consulting, or outside counsel roles.
