This is a fully remote position, open to applicants in United States.
• Provide guidance to enterprise clients regarding U.S. federal and state privacy legislation.
• Offer counsel on CCPA/CPRA alongside emerging comprehensive privacy laws at the state level.
• Advise on privacy obligations for websites, applications, products, and services.
• Tackle privacy issues related to marketing, advertising technologies, cookies, tracking, and digital platforms.
• Counsel on data collection, usage, sharing, retention, and disclosure practices.
• Manage vendor and third-party privacy concerns.
• Provide advice on privacy-by-design principles.
• Address requirements surrounding international data transfers.
• Draft and negotiate Data Processing Agreements (DPAs) and Standard Contractual Clauses (SCCs).
• Create and review privacy policies, privacy notices, and terms of use.
• Draft and negotiate technology and commercial contracts.
• Advise on provisions related to data security and confidentiality.
• Address issues of indemnification, liability limitations, warranties, insurance, and other risk-allocation matters.
• Develop and oversee privacy compliance programs, including data mapping, audits, and governance strategies.
• Advise on data security incidents and formulate incident response plans.
• Collaborate closely with business, technology, security, marketing, and legal teams.
• Provide practical, business-focused legal counsel.
• Independently manage complex legal issues.
• Mentor, train, or lead other attorneys as necessary.
• Serve as outside General Counsel and a trusted business advisor.
• Seek opportunities for leadership, practice development, secondment, and handling overflow transactional work.
• A minimum of 5 years of experience in Data Privacy Law.
• In-depth understanding of U.S. privacy and data security regulations.
• Practical experience with CCPA/CPRA and state privacy laws across the U.S.
• Proficient in drafting and negotiating DPAs, privacy clauses, and commercial contracts.
• Strong background in transactional matters and contract negotiations.
• Excellent skills in client counseling and communication.
• Capability to independently manage complex legal issues.
• Exceptional attention to detail and quality of deliverables.
• Strong judgment, ownership, and follow-through abilities.
• Ability to work effectively with senior-level business and legal stakeholders.
• Graduate from a Top 60 U.S. law school or within the top 20% of the law school class.
• Active U.S. bar license in at least one jurisdiction.
• Experience with various commercial and transactional agreements, including technology, SaaS, vendor, and other business contracts.
• Proven track record in advising clients on data privacy, technology, marketing, and commercial issues.
• Familiarity with marketing privacy, cookies, tracking technologies, AdTech, CRM, analytics, and consumer data practices.
• Experience in developing or managing privacy programs, including data mapping, compliance assessments, policies, procedures, and vendor risk management.
• Ability to effectively communicate with sophisticated clients and work collaboratively with executive, technology, security, and business teams.
• Preferred: Experience in enterprise or in-house legal roles.
• Preferred: Background in working as a seconded or embedded legal resource.
• Preferred: Experience advising consumer-facing brands.
• Preferred: Involvement in privacy matters relating to marketing and advertising technology.
• Preferred: Experience with technology transactions.
• Preferred: Familiarity with SaaS and/or MarTech.
• Preferred: CIPP/US or CIPP/E certification.
• Preferred: Experience with GDPR and international privacy regulations.
• Preferred: Background in data security incident response.
• Preferred: Experience developing or managing corporate privacy initiatives.
