This is a fully remote position, open to applicants in Texas.

📋 Description

• Provide guidance to enterprise clients regarding U.S. federal and state privacy regulations.

• Advise clients on the California Consumer Privacy Act (CCPA/CPRA) and developing state comprehensive privacy legislation.

• Offer insights into privacy obligations for websites, applications, products, and services.

• Counsel on issues related to marketing, advertising technology, cookies, tracking, and privacy across digital platforms.

• Guide on data collection, usage, sharing, retention, and disclosure practices.

• Manage privacy matters concerning vendors and third parties.

• Address considerations related to privacy-by-design.

• Advise on international data transfers and associated requirements.

• Draft and negotiate Data Processing Agreements (DPAs) and Standard Contractual Clauses (SCCs).

• Create and review privacy policies, notices, and terms of use.

• Draft and negotiate technology and commercial contracts.

• Address provisions related to data security, confidentiality, indemnification, limitation of liability, warranties, insurance, and other risk allocation issues.

• Develop and oversee privacy compliance programs, data mapping, audits, and governance frameworks.

• Advise on data security incidents and planning for incident response.

• Collaborate closely with business, technology, security, marketing, and legal teams.

• Provide practical, business-focused legal counsel.

• Engage directly with sophisticated clients and work alongside executive stakeholders.

• Potentially mentor, train, or lead other legal professionals.

• May serve as an outside General Counsel and trusted advisor to businesses.


⛳️ Requirements

• A minimum of 5 years of dedicated experience in Data Privacy Law.

• Active bar license in at least one U.S. jurisdiction.

• Comprehensive knowledge of U.S. federal and state privacy and data protection laws, including CCPA/CPRA.

• Practical experience in drafting, reviewing, and negotiating Data Processing Agreements (DPAs) and privacy/data security provisions.

• Background in commercial and transactional agreements, including technology, SaaS, vendor, and other business contracts.

• Demonstrated experience advising clients on data privacy, technology, marketing, and commercial issues.

• Familiarity with marketing privacy, cookies, tracking technologies, AdTech, CRM, analytics, and consumer data practices.

• Experience in developing or managing privacy programs, including data mapping, compliance assessments, policies, procedures, and vendor risk management.

• Ability to independently manage complex legal issues, communicate effectively with sophisticated clients, and collaborate with executive, technology, security, and business teams.

• Graduate of a Top 60 U.S. Law School or ranked within the Top 20% of the graduating class.

• Strong background in transactional law and contract negotiation.

• Excellent client counseling and communication abilities.

• High attention to detail and quality of work product.

• Demonstrated sound judgment, ownership, and follow-through.

• Experience in mentoring, training, or leading other attorneys is highly regarded.

• Preference for candidates with enterprise or in-house legal experience.

• Experience as a seconded or embedded legal resource is preferred.

• Previous experience advising consumer-facing brands is desirable.

• Experience in privacy matters related to marketing and advertising technology is a plus.

• Familiarity with technology transactions is preferred.

• Experience in SaaS and/or MarTech is advantageous.

• CIPP/US or CIPP/E certification is preferred.

• Familiarity with GDPR and international privacy regulations is a plus.

• Experience in data-security incident response is desirable.

• Experience in developing or managing corporate privacy programs is advantageous.
