Professional Liability Claims Counsel

This is a fully remote position, open to applicants in New York.

📋 Description

• Conduct independent investigations, evaluations, and management of professional liability claims from initiation to resolution.

• Assess coverage matters and ascertain the relevance of policy terms, conditions, and exclusions.

• Set and modify reserves according to developments in claims.

• Formulate and implement strategies for resolving claims, which include negotiation and settlement.

• Direct litigation strategies encompassing discovery, motion practices, mediation, and trial preparation.

• Participate in mediations, settlement discussions, and trials as needed.

• Analyze liability and damages using legal, factual, and industry-specific expertise.

• Provide financial forecasting for claims portfolios.

• Engage proactively with insured parties, brokers, and management.

• Deliver updates on claims and determinations regarding coverage.

• Assist underwriting teams by providing insights into claims and loss trends.

• Ensure compliance with regulatory standards, internal protocols, and best practices in claim handling.

• Compile reports for management, insurers, reinsurers, and auditors.

• Identify new issues, trends, and risks in professional liability.

• Offer feedback to underwriting and risk management related to loss drivers and prevention strategies.

⛳️ Requirements

• A New York State Adjuster License is required; licenses from multiple states are preferred.

• A JD degree is preferred.

• 3-5 years of experience in managing professional liability claims.

• Comprehensive knowledge of claims practices, litigation processes, and insurance coverage.

• Experience in handling complex and/or high-exposure claims.

• Proven ability to work autonomously and make sound judgment calls.

• Exceptional negotiation, analytical, and organizational abilities.

• Strong written and verbal communication skills.

• Proficiency in claims management systems and the Microsoft Office suite.

• Experience in one or more specialty areas (e.g., Education, Public Entity, EPLI, E&O) is preferred.

• Previous litigation experience or a legal background is preferred.

• Familiarity with excess and surplus lines or specialty insurance markets is preferred.

• Experience with reinsurance reporting and complex coverage issues is preferred.
