This is a fully remote position, open to applicants in United States.
• Act as the main legal advisor to Product and related Engineering teams, offering guidance throughout the entire product lifecycle—from initial design to launch—ensuring that legal risks are identified and mitigated early rather than at the end of the process.
• Evaluate privacy-by-design principles across Solace: provide advice on data flows, the collection, utilization, and safeguarding of PHI and other sensitive information, as well as compliance with HIPAA/HITECH, state consumer health privacy laws (e.g., Washington's My Health My Data Act), CCPA/CPRA, and other relevant U.S. privacy and security mandates.
• Spearhead privacy assessments for new features and services, including AI-driven functionalities, and convert the findings into actionable product requirements.
• Collaborate with Marketing on advertising claims, consumer protection, FTC considerations, and ad-tech practices.
• Draft, negotiate, and maintain the legal documentation that is user-facing for our products—terms of service, consents, privacy notices, and telehealth-related disclosures—and ensure they are updated in line with evolving products and regulations.
• Provide counsel on data-sharing agreements and vendor/partner integrations that involve product data, working in coordination with the commercial and compliance teams on BAAs, DPAs, and related terms.
• Create templates, playbooks, and self-service resources to aid a rapidly expanding product organization without becoming a bottleneck.
• Collaborate cross-functionally with Security, Compliance, Operations, and Finance, and know when to escalate matters to the Chief Legal Officer and leadership.
• JD from an accredited law school and active bar membership in good standing.
• 3-6 years of experience advising product and engineering teams on privacy and technology issues.
• Strong foundation in healthcare privacy and data protection—HIPAA/HITECH along with U.S. state privacy laws—preferably within a healthcare, digital health, or other regulated sector.
• Proficient in the product counsel toolkit: AI/ML, intellectual property, consumer protection, and advertising/marketing law.
• Good instincts regarding risk versus speed, with the ability to provide substantive answers rather than evasive responses.
• Exceptional communication and cross-functional collaboration abilities—you can distill complex issues into actionable insights for product and engineering teams.
• Preferred qualifications: privacy certification (e.g., CIPP/US); experience in health data marketing/ad-tech; and familiarity with telehealth or marketplace models.
