
Legal and Deficiency Recovery Manager

This is a fully remote position, open to applicants in United States.
• Develop and manage qualification criteria for the legal escalation of post-charge-off deficiency balances.
• Conduct audits on account routing, oversee the legal escalation pipeline, assess exceptions, and uphold compliance logs.
• Review and authorize settlement letters, deficiency collection scripts, and structures for settlement authority.
• Take charge of legal and compliance reporting, preparing quarterly updates for the Board.
• Carry out FDCPA and UDAAP assessments and maintain a legal viability map on a state-by-state basis.
• Ensure compliance with ECOA and SCRA and oversee bankruptcy filings.
• Coordinate responses to inquiries from the CFPB, matters involving state attorneys general, and regulatory consumer complaints.
• Design and deliver compliance training for staff involved in post-charge-off activities.
• Evaluate third-party collection agencies and supervise agency compliance, audits, complaints, monitoring, and remediation efforts.
• Assess and manage outside counsel, including referrals, case outcomes, billing, and recovery expenses.
• Draft and maintain post-charge-off policies and procedures, ensuring version control.
• Oversee collections-related litigation and maintain litigation reporting.
• Identify legal risks and recovery gaps and implement effective solutions.
• Offer legal and compliance advice to collections personnel.
• Recruit and develop direct reports as program volume expands.
• Minimum of 5 years of experience in legal operations, compliance management, or collections oversight in consumer lending, auto finance, or a third-party collection agency.
• Proven track record of career stability.
• Specific experience in non-prime or subprime auto lending.
• Familiarity with FDCPA, UDAAP, and relevant state consumer protection laws pertaining to post-charge-off collections.
• Experience managing bankruptcy filings within a consumer lending portfolio.
• Proficient in handling SCRA compliance for servicemember accounts.
• Experience in managing relationships with outside counsel, including defining scope, reviewing billing, enforcing deadlines, and addressing performance issues.
• Background in or alongside a deficiency recovery operation.
• Capability to interpret collections performance data.
• Bachelor's degree is required.
• JD, paralegal certification, or CRCM is preferred but not mandatory.
• Strongly preferred experience in designing, building, or leading a post-charge-off deficiency recovery program.
• Preferred experience managing legal collections across multiple states.
• Preference for experience in building or administering agency compliance monitoring programs.
• Background at a non-prime auto lender or servicer is highly preferred.
