This is a fully remote position, open to applicants in United States.
• Act as the primary legal advisor for the 340B function concerning legal, regulatory, and compliance matters related to federal programs and government pricing reports.
• Provide guidance to the Value & Access departments on issues pertaining to the Anti-Kickback Statute, False Claims Act, and competition law.
• Offer strategic legal advice to senior leadership on matters of product pricing and access.
• Advise on best price, WAC, AMP, ASP, along with federal and state price reporting.
• Draft, review, and negotiate intricate agreements with government entities, payers, and trade partners.
• Analyze and apply state and federal laws, regulations, and policies to guide business operations.
• Recognize and communicate risks linked to complex business activities.
• Create legal strategies and alternative factual scenarios to support business goals.
• Lead negotiations on behalf of clients.
• Collaborate with other in-house legal counsel and oversee external legal advisors.
• Supervise administrative assistants, paralegals, and additional departmental staff.
• Mentor and train junior attorneys and other departmental staff.
• Stay informed about evolving legal and business trends as well as the client's operational landscape.
• Juris Doctorate from an accredited law institution.
• A minimum of eight (8) to ten (10) years of pertinent legal experience.
• Licensed to practice law in at least one State bar.
• Expertise in at least two specialized legal areas essential to business operations.
• In-depth understanding of products, competitors, and the regulatory landscape.
• Exceptional verbal and written communication abilities.
• Strong organizational skills.
• Ability to exercise discretion and maintain confidentiality.
• Proficient in government price reporting regulations, including AMP, Best Price, ASP, 340B, and/or federal health care program contracting.
• Must possess legal authorization to work in the United States without limitations.
• Willingness to undergo a drug test and post-offer physical examination, if necessary.
• Must be at least 18 years of age.
