
Claim Counsel – EPL/Professional Liability

This is a fully remote position, open to applicants in Alabama.
• Review and analyze EPL, Professional Liability (E&O), BOP, and GL policies, endorsements, and relevant statutes.
• Evaluate coverage issues such as wrongful termination, discrimination, harassment, wage and hour liabilities, professional negligence, and triggers for bodily injury/property damage under GL.
• Draft and issue coverage position letters, including reservations of rights and denial letters, ensuring clarity and adherence to legal and regulatory standards.
• Assess and provide feedback on coverage forms and policy language as required by insurers.
• Manage and conduct intricate claims investigations related to employment allegations, professional services risks, and occasional GL-related losses.
• Analyze liability and damages in cases involving back pay, front pay, emotional distress, punitive damages, and economic losses.
• Create and implement strategic plans for claim resolution, including the oversight of litigation when needed.
• Provide insurers with independent evaluations of claims based on investigations, experience, and insights from external experts and legal counsel.
• Assess exposure and make settlement recommendations, including establishing and managing reserves in line with carrier guidelines.
• Negotiate settlements within authority limits, maintaining a balance between legal risk, financial exposure, and business objectives.
• Participate in mediations and settlement discussions as necessary.
• Ensure all claims handling adheres to Department of Insurance regulations and internal protocols.
• Maintain precise and comprehensive documentation in the claims management system, including coverage analyses and strategic recommendations.
• Act as a trusted advisor to internal teams and carriers regarding EPL, Professional Liability, and GL-related coverage issues.
• Serve as the primary resource for coverage and strategy in engagements with external counsel, policyholders, and other stakeholders.
• Juris Doctor (JD) with active bar membership in good standing, or
• 7–10+ years of senior-level experience managing EPL, Professional Liability, GL, or similar complex liability claims.
• Active adjuster licenses and a willingness to acquire and maintain additional licenses as necessary.
• Proven expertise in insurance coverage analysis and policy interpretation.
• Experience in issuing or advising on coverage positions, including reservations of rights and denials.
• Strong comprehension of liability, damages, and litigation strategies.
• Experience in managing high-frequency EPL programs and familiarity with panel counsel management and billing practices in EPL matters.
• Exceptional analytical, negotiation, and communication abilities.
• Capability to independently manage multiple high-severity, complex claims.
• Proficiency with claims management systems and associated tools.
