This is a fully remote position, open to applicants in Alabama.
• Assess and interpret Environmental/Pollution Liability, Professional Liability (E&O), and associated policies, including manuscript forms and endorsements.
• Investigate coverage matters such as pollution conditions, the distinction between gradual and sudden releases, remediation expenses, third-party bodily injury and property damage, as well as professional services exposures.
• Review the relevance of exclusions, known conditions, prior acts, and allocation matters between covered and uncovered losses.
• Draft and distribute coverage position letters, which include reservations of rights and denial letters.
• Offer insights on policy forms, language, and emerging issues related to environmental coverage.
• Manage complex claims that involve site contamination, environmental cleanups, regulatory actions, natural resource damages, and errors or omissions in professional services.
• Collaborate with environmental consultants, engineers, remediation specialists, and legal representatives to assess liability, causation, and damages.
• Evaluate exposures related to remediation costs, business interruptions, bodily injuries, property damage, and long-tail environmental liabilities.
• Formulate and execute strategic approaches for claim resolution, including the management of litigation and regulatory procedures.
• Provide carriers with independent, well-reasoned claim assessments backed by expert analysis and investigation results.
• Assess exposure and suggest settlement recommendations, including intricate cost allocation among remediation, defense, and indemnity components.
• Establish and oversee reserves that reflect long-tail and evolving environmental exposures.
• Negotiate settlements and engage in mediations, regulatory discussions, and multi-party resolutions.
• Ensure all claims handling adheres to Department of Insurance regulations and relevant environmental regulatory frameworks.
• Keep comprehensive documentation of coverage analyses, remediation strategies, and regulatory developments within the claims management system.
• Act as a trusted advisor to internal teams and carriers concerning environmental and professional liability coverage issues and trends.
• Function as the main point of contact with coverage counsel, environmental consultants, defense attorneys, insured parties, brokers, and regulatory bodies.
• Deliver clear reports to carriers, covering coverage analysis, exposure assessments, and updates on remediation strategies.
• Juris Doctor (JD) with active bar membership in good standing, or
• 7–10+ years of senior-level experience in managing Environmental Liability, Pollution Liability, Professional Liability, or similar intricate claims.
• Active adjuster licenses and a commitment to obtain and sustain additional licenses as required.
• Proven expertise in coverage analysis and policy interpretation for environmental and/or professional liability lines.
• Experience in issuing or advising on coverage positions, including reservations of rights and denials.
• Strong comprehension of environmental exposures, remediation processes, and associated damages.
• Capability to evaluate long-tail claims, allocation challenges, and multi-party liability situations.
• Exceptional analytical, negotiation, and communication abilities.
• Capacity to independently manage multiple high-severity, complex claims.
• Proficiency in claims management systems and related tools.
