This is a fully remote position, open to applicants in United States.
• Deliver strategic legal guidance to Product, Engineering, Risk, Compliance, and Operations teams to facilitate Upstart's HELOC product and its transition from a state-licensed lender to a national bank.
• Offer legal counsel and insights on potential future products, which may encompass purchase-money mortgages.
• Provide advice on federal and state consumer lending regulations, mortgage laws, and regulatory changes that influence home lending products and services.
• Collaborate with cross-functional stakeholders to create compliant product features, customer interactions, operational workflows, and servicing capabilities.
• Oversee legal support for new product initiatives, regulatory change management, and market expansion activities tied to home lending.
• Work in partnership with the Product & Regulatory Legal team and other legal departments, including those focused on Privacy, Fair Lending, Capital Markets, and Commercial contracts, as needed.
• Craft practical legal frameworks, policies, and guidance that foster business growth while effectively managing legal and regulatory risks.
• Engage with internal and external stakeholders, such as regulators, banking partners, and outside legal counsel, concerning legal issues impacting the HELOC business.
• Recognize and relay significant legal risks to business partners; proficient in simplifying intricate legal issues and risks for senior leadership in a clear and actionable format, condensing complex concepts into straightforward recommendations.
• Juris Doctor (JD) degree from an accredited law school and active membership in at least one U.S. state bar.
• A minimum of 10 years of legal experience advising financial services, fintech, or mortgage lending organizations, including considerable experience as the lead legal advisor for complex product organizations focusing on real-estate secured products.
• Extensive knowledge of consumer financial services laws and mortgage regulations, including TILA, RESPA, ECOA, FCRA, HMDA, UDAAP, and relevant state lending and federal banking laws.
• Experience in advising cross-functional product development teams and supporting the launch or expansion of regulated financial products.
