This is a fully remote position, open to applicants in California.
• Take charge of global tax compliance, including corporate income tax (CIT), transfer pricing, and US state/sales/use tax for all Atari entities in the US, UK, Sweden, Australia, India, Germany, Luxembourg, France, and Canada.
• Manage indirect tax compliance for digital goods and electronically supplied services across all markets, encompassing EU VAT, UK VAT, Australia GST, India GST, and Canada GST/HST/PST, while addressing marketplace deemed-supplier rules, platform collection splits (Steam, Nintendo, Apple, Sony, and others), digital services taxes (DSTs), and microtransactions.
• Oversee all external advisor relationships and establish the in-house/co-source model across various jurisdictions.
• Handle IP structuring and transfer pricing for Atari's franchises from start to finish — conducting DEMPE analysis to determine where IP value is generated, held, and compensated; managing intercompany agreements, cost-sharing arrangements, and periodic true-ups; as well as addressing cross-border withholding tax implications of royalty, licensing, and financing flows, including treaty analysis and relief/refund claims.
• Identify and optimize global R&D tax credits and video game production incentives in all studio jurisdictions, managing the entire lifecycle from qualification through documentation and claim submission.
• Direct the ASC 740 tax provision process, including uncertain tax positions (FIN 48), in collaboration with external auditors, and work alongside FP&A on effective tax rate planning and monitoring.
• Lead the defense of Atari's positions on digital revenue sourcing, nexus, and transfer pricing during US federal, state, and international audits.
• Keep abreast of tax legislative and regulatory changes in all operating jurisdictions, including OECD Pillar Two, and proactively advise leadership on impacts and necessary actions.
• Counsel product, business development, and studio teams on the tax ramifications of digital marketplace frameworks, platform economics, and new commercial agreements.
• Provide tax-related support for M&A due diligence and integration as Atari continues to expand through acquisitions.
• Manage the Luxembourg parent company's tax responsibilities, including corporate income tax, net wealth tax, the parent-company reporting cycle, and Euronext-listed disclosure requirements, while addressing outstanding issues from the redomiciliation, such as exit/migration tax exposure, treaty access, and substance requirements, as well as the confirmation of the future holding and IP ownership structure.
• Oversee India-specific tax obligations due to the local presence, including GST, equalization levy/significant economic presence, India withholding tax, and the practical challenges associated with cash repatriation.
• Assess permanent establishment risks arising from distributed and remote teams and traveling executives, while leading cash repatriation planning, foreign tax credit optimization, and considerations related to functional currency and FX across the entity chain.
• Develop a group tax governance and risk framework suitable for a public company, including tax risk reporting at the board and audit committee levels, and managing relationships with national tax authorities and local advisors in each jurisdiction.
• 12+ years of experience in corporate tax, with a minimum of 3 years in the gaming, SaaS, or digital media sectors.
• Extensive technical knowledge in international tax, including transfer pricing, BEAT, GILTI, and Pillar Two, as well as US state and local tax regulations for digital goods.
• Practical experience with automated tax engines like Avalara or Vertex, along with integration into ERP or billing systems.
• An active CPA license is required; a Master of Taxation (MST) is preferred.
• A background in Big 4 firms with experience transitioning to in-house roles is the ideal candidate profile for this position.
• Ability to function as the sole in-house tax leader, strategically collaborating with external partners rather than solely relying on internal staffing.
• Excellent communication skills to convey complex tax concepts to non-tax stakeholders, including studio leadership and the board.
• Proven experience working within a group based in a European holding jurisdiction.
• Practical knowledge in cross-border IP and royalty structuring, withholding tax and treaty mechanics, and indirect tax on digital services across various jurisdictions.
