This is a fully remote position, open to applicants in New York.
• Assist in the design and expansion of the legal and compliance framework that will facilitate Dreem Health's upcoming growth phase.
• Act as the primary legal authority within the company, holding significant responsibilities in regulatory strategy, health care compliance, corporate governance, payor contract evaluation, maintenance of certifications, and more.
• Develop systems that promote growth while collaborating effectively with external counsel as necessary.
• Oversee the comprehensive HIPAA/HITECH compliance program, including policies, training, incident response, and audits.
• Navigate the complex landscape of state telehealth regulations and translate these into operational policies.
• Manage the legal and compliance framework related to AI-assisted clinical tools, encompassing privacy obligations and informed consent documentation.
• Juris Doctor from an accredited law school and active admission to the U.S. bar.
• Over 7 years of relevant legal experience, including in-house roles at a telemedicine or digital health company, and/or significant experience in digital health, telehealth, or health-tech acquired at a private or publicly traded organization or large law firm.
• Strong expertise in HIPAA/HITECH, including negotiating Business Associate Agreements (BAAs) and providing privacy guidance and compliance program support.
• Experience advising on state telehealth, licensure, and professional entity matters across various states.
• Familiarity with health care fraud and abuse laws and understanding of their application to digital health arrangements.
• Demonstrated success in a high-growth startup or scale-up setting, preferably as the primary legal resource or in a position with significant autonomy and wide-ranging responsibilities.
• Experience in reviewing and negotiating complex commercial agreements, including digital health platform contracts, partner agreements, vendor agreements, and BAAs.
• Capacity to work independently in a dynamic environment and collaborate cross-functionally with clinical, operations, product, and commercial teams.
