This is a fully remote position, open to applicants in United States.
• Act as the primary in-house counsel for employment law, providing guidance to HR, management, and business leaders on a wide array of employment issues, including hiring, onboarding, and executive compensation.
• Offer advice on employment matters involving international subsidiaries and employees situated in Europe and Asia, coordinating with local employment counsel as needed across pertinent jurisdictions.
• Deliver practical and timely advice on federal, state, and local employment laws, encompassing Title VII, the ADA, ADEA, FMLA, FLSA, NLRA, and corresponding state equivalents.
• Counsel on leave of absence programs, accommodation requests, and associated ADA and FMLA compliance issues.
• Guide HR and management on wage and hour compliance, employee classification, independent contractor status, and pay equity concerns.
• Advise on cross-border employment matters, including expatriate and secondment arrangements and ensuring compliance with local labor regulations.
• Assist HR with international hiring, terminations, and restructuring efforts, collaborating with local counsel to meet applicable legal requirements.
• Collaborate with HR on the creation, implementation, and updating of employment policies, employee handbooks, and workplace compliance initiatives.
• Provide counsel on executive employment agreements, offer letters, severance packages, and non-competition and non-solicitation agreements, while drafting, reviewing, and negotiating general commercial contracts and vendor agreements in support of HR and business functions.
• Aid in compensation-related disclosures in public documents such as proxy statements.
• Facilitate due diligence and offer employment law-related counsel in relation to M&A transactions.
• Keep abreast of federal, state, and local legislative and regulatory changes impacting employment law and proactively inform HR and management on compliance responsibilities and necessary policy modifications.
• Design and conduct employment law training programs for HR professionals, managers, and employees on subjects like anti-harassment, workplace conduct, leave management, and wage and hour compliance.
• Assist with audits and compliance reviews of employment practices, including I-9 and immigration-related compliance.
• Collaborate with HR and Benefits on compliance issues concerning employee benefit plans, including ERISA and ACA considerations, as applicable.
• J.D. with active membership in good standing with at least one U.S. state bar.
• Over 5 years of employment law experience, ideally with a blend of law firm and in-house practice.
• Extensive experience providing counsel on a wide range of employment issues, including employee relations, workplace investigations, leaves of absence, wage and hour compliance, and separations.
• Experience overseeing employment litigation and government agency proceedings, including management of outside counsel.
• Familiarity with federal and state employment laws across various U.S. jurisdictions.
• Proven ability to deliver practical, business-focused legal advice and to cultivate effective relationships with HR and business partners.
• Excellent written and verbal communication skills, with the ability to convert complex legal matters into clear, actionable recommendations.
• Capability to manage multiple cases independently in a dynamic environment with competing priorities.
