This is a fully remote position, open to applicants in Massachusetts.
• Develop and manage the criteria for determining which accounts with a deficiency balance qualify for legal escalation.
• Oversee the legal escalation pipeline to ensure appropriate accounts are being addressed and that the criteria are applied correctly.
• Review and authorize all content for settlement letters prior to any correspondence being mailed.
• Evaluate and endorse the deficiency collection contact script and settlement authority structure before implementation with borrowers.
• Take ownership of the legal and compliance reporting within the collections KPI package.
• Conduct FDCPA and UDAAP assessments of consumer-facing components before their launch and provide necessary approvals.
• Create and maintain a comprehensive state-by-state legal viability map for deficiency collections throughout the portfolio.
• Ensure that all deficiency collection methods across borrower segments are based on loan attributes rather than internal product or program classifications.
• Oversee bankruptcy filings within the portfolio.
• Coordinate compliance responses concerning CFPB inquiries, state attorney general issues, and consumer complaints escalated through regulatory channels.
• Develop and deliver compliance training for post charge-off staff prior to interacting with any live accounts.
• Vet all third-party collection agencies prior to account placement.
• Manage the ongoing agency compliance program.
• Supervise third-party BPO partners handling post charge-off accounts.
• Lead the evaluation and selection process for outside counsel involved in the legal escalation pipeline.
• Draft and maintain all policies and procedures related to the post charge-off collections program.
• Manage active litigation related to collections in collaboration with outside counsel.
• Identify process gaps that may lead to legal exposure or result in missed recovery opportunities.
• Act as the legal and compliance resource for daily inquiries from collection agents, team leads, and directors.
• Recruit and mentor direct reports as the program volume expands.
• A minimum of 5 years of experience in legal operations, compliance management, or collections oversight within consumer lending, auto finance, or a third-party collection agency.
• Proven history of career stability.
• Specific experience in non-prime or subprime auto lending.
• Solid understanding of FDCPA, UDAAP, and relevant state consumer protection regulations as they pertain to post charge-off collections.
• Experience managing bankruptcy filings within a consumer lending portfolio and ensuring SCRA compliance for servicemember accounts.
• Experience managing relationships with outside counsel.
• Familiarity with operations related to deficiency recovery.
• Ability to analyze and interpret collections performance data independently, without reliance on a data team for validation.
• Bachelor's degree is required; JD, paralegal certification, or CRCM is preferred but not mandatory.
