• Oversee CON litigation engagements as the firm’s expert witness, collaborating closely with client attorneys to formulate case strategies, develop supporting evidence, and provide testimony in contested case proceedings before administrative law judges.
• Act as Ascendient’s leading expert witness in contested CON hearings across various states, with a strong focus on North Carolina.
• Create and implement litigation strategies in direct collaboration with client attorneys.
• Write expert reports and pre-filed written testimony that are analytically robust and fully defensible under cross-examination.
• Prepare hearing exhibits and supporting analytical materials related to CON review criteria, including need analysis, financial feasibility, utilization projections, and service area assessments.
• Attend and engage in all aspects of hearings, including those that may last several weeks.
• Get ready for and provide deposition testimony as needed.
• Mentor and develop the firm’s Opposition Lead, with the possibility of serving as their direct supervisor as the practice expands.
• Contribute to the evolution of the firm’s litigation methodology, standards, and analytical capabilities over time.
• Formally qualified and recognized by an administrative law judge or hearing officer as an expert witness in CON, healthcare regulatory matters, or other administrative law hearings.
• Experience testifying in at least 3–5 administrative law hearings (7 or more preferred).
• Direct involvement with Certificate of Need processes, review criteria, and state health planning frameworks.
• Proven ability to withstand rigorous cross-examination and defend analytical methods under adversarial conditions.
• Experience in drafting expert reports or pre-filed written testimony for administrative proceedings.
• Background in hospital financial modeling and feasibility analysis.
• Extensive understanding of hospital and health system operations, service line dynamics, and utilization data.
• Familiarity with healthcare data sources such as CMS datasets, AHA data, state health planning databases, and similar resources.
